Long Drive Transportation Services Proprietary Limited is a long-distance ride-sharing application, connecting Drivers with empty seats to people travelling the same direction.




Terms and Conditions Of Use


These terms and conditions of use constitute a binding legal agreement (the “Agreement” or “Terms and Conditions of Use”) between you and Long Drive Transportation Services Proprietary Limited (“LongDrive”, “we,” “us” or “our”) governing your right of use of the LongDrive application and website (collectively, the “LongDrive Platform”). This Agreement applies to all Users. All references “you”, “your”, “yourself” in this Agreement applies to all Users unless otherwise stated.




Regarding this agreement,


“Account” means the account that must be created in order to become a User and access the Platform;


“Claim” means that the Passenger was not satisfied with the service provided by the Driver and such dissatisfaction was due to Driver not following the T&Cs of the Platform. Example, a Driver dropped off the Passenger at a destination not agreed upon nor per the Trip post.


“Trip” means the journey offered by a Driver on the Platform, and for which he agrees to transport Passengers in exchange for the cost sharing;


“Ride price” means, for a given Trip, the sum of money requested by the Driver and accepted by the Passenger for his contribution to the travel costs, including D2D fee;


“Driver” means the User using the Platform, to offer transport to another individual in exchange for the cost sharing, for a Trip and at a time defined by the Driver alone;


“User” means any individual having signed up and verified on the on the Platform;


“Passenger” means the User having accepted the offer to be transported by the Driver or, where applicable, the person on whose behalf a User has booked a Seat;


“Platform” means the mobile application made available by LongDrive for use when searching and posting rides


“Service Fee” means all the fees charged by LongDrive for the use of the Platform


“T&Cs” means these Terms and Conditions.


“Website” means the website accessible at the address


  1. Our Mission

Our mission is to provide a secured, reliable, and affordable private and convenient way of traveling between provinces and cities. We aim to save ordinary South Africans money by being their first option when considering taking long Trips using a mobile application.


  1. Accessing and Signing Up onto the Platform

    1. Age Limitation

  • The Platform may be used by individuals aged 18 or over.

  • Registration on the Platform by a person underage of 18 is strictly prohibited.

  • In signing up, accessing, using, or registering on the Platform, you represent and warrant that you are aged 18 or over.

    1. Account and User creation

  • When creating an Account, you agree to provide accurate and true information, and to update it through your profile to guarantee its relevance and accuracy throughout your contractual relations with LongDrive.

  • You agree to keep the password chosen upon creating your Account secret and not to communicate it to anybody.

  • If you lose or disclose your password, you undertake to inform LongDrive immediately.

  • You alone are responsible for the use of your Account by third parties, unless you have expressly notified LongDrive of the loss, the fraudulent use by a third party, or the disclosure of your password to a third party.

  • You agree not to create or use, under your own identity or that of a third party, Accounts other than that initially created.

    1. Verification

  • All Users of the Platform are required to be verified prior to accessing the Platform.

  • By signing up onto the Platform, you acknowledge and accept that LongDrive using third-party technology will verify your identify through 3D liveness technology that matches your live image, Identity number, Identity book or card details (including names) to the South African Home Affairs Database.

  • Verification is done for security purposes only – it allows LongDrive to only onboard Users who are genuine onto the Platform which ultimately ensures safety for all Users.


  1. Use of the Platform

The Platform should only be used to offer and find a ride.

  1. Offering a ride

  • As a User who is willing to offer a ride (lift) to other Users, and if you fulfil the conditions below, you can create and post your Trip on the Platform by entering information about such Trip such as dates, times, number of seats offered etc.

  • You are only authorised to offer a ride if you fulfil all the following conditions:

  1. you hold a valid driving licence;

  2. you only offer a ride for vehicles you own or use with the express permission of the owner, and in all cases that you are authorised to use for the purposes of ridesharing;

  3. you are and remain the main Driver of the vehicle of your Trip post;

  4. the vehicle has valid third party insurance;

  5. you have no medical incapacity for driving;

  6. the vehicle you intend to use for the Trip has 4 wheels and a maximum of 7 seats;

  7. you do not intend to post more than once for the same Trip;

  8. you do not offer more than 3 Seats;

  9. all Seats offered have a seatbelt;

  10. to use a vehicle in good working order and which complies with the applicable legal provisions and customs;

  11. you are a consumer and do not act as a professional.

  • You recognise that you are solely responsible for the content of your Trip post on the Platform.

  • Consequently, you represent and warrant the accuracy and truthfulness of all information contained in your Trip post, and you undertake to fulfil the Trip under the conditions described in your post.

  • LongDrive reserves the right, at its sole discretion and without notice, to not post or to remove, at any time, any Trip post that does not comply with the T&Cs or that it considers as damaging to its image, that of the Platform.

  • You are informed that if you present yourself as a consumer by using the Platform when in fact you act as a professional, you are exposed to sanctions provided by the applicable law.

  • When you post a ride, you are agreeing to pay all Service Fees applicable.


  1. Finding a ride

  • LongDrive has set up a system for booking seats online for Trips offered on the Platform.

  • You can find a ride on the Platform by inputting the location you wish to depart from and location you are heading to, travel date and number of seats you wish to book.

  • When you find a ride that suits your needs, you may make a booking request which will either be accepted or declined by the User offering a ride of the Trip you requested to book.

  • When you book a ride, you are agreeing to pay all charges for your booking including the Ride price, D2D price where applicable and Service Fees.


  1. My Trips

  • At the time of the booking confirmation, LongDrive will avail on the Platform the telephone number of the Driver (if you are the Passenger) or of the Passenger (if you are the Driver).

  • The telephone number should solely be used for the purpose of conducting the Trip.


  1. Door to Door feature (D2D)

  • When the Driver posts their Trip, they will have an option to offer a D2D Trip. The Passenger will also have the option to select the D2D Trip if they wish.

  • A D2D Trip is applicable when the Passenger’s and the Driver’s departure and arrival location is above 10 kilometres but within 30 kilometres of the total distance from the departure and arrival location of the Driver.

  • The D2D Trip fee is limited to R50.


  1. Non-commercial and non-business purpose of the Services and the Platform

  • You agree to use the Platform only to be put into contact, on a non-business and non-commercial basis, with people wishing to share a Trip with you.

  • As a Driver, you agree not to request a Ride price higher than the costs you incur and that may generate a profit, being specified that in the context of a cost sharing, you must bear as a Driver your own part of the costs induced by the Trip. You are solely responsible for calculating the costs you incur for the Trip and for checking that the amount requested of your Passengers does not exceed the costs you incur (excluding your share of the costs).

  • LongDrive reserves the right to suspend your Account in the case where you use a chauffeur-driven or other business vehicle or taxi, or a company car, and due to this, generate a profit from the Platform. You agree to provide to LongDrive, on its simple request, a copy of your car registration certificate and/or any other document showing that you are authorised to use this vehicle on the Platform and are not drawing any profit therefrom.

  • LongDrive also reserves the right to suspend your Account, limit your access to the Platform, or terminate these T&Cs, in the case of activity by you on the Platform which, owing to the nature of the Trips offered, their frequency, the number of Passengers carried and the Ride price requested, entails a situation of profit for you, or for any reason suggesting to LongDrive that you are generating a profit on the Platform.


  1. Service Fees

  • To help LongDrive run smoothly and to cover the cost of services like third-party verification features, online payments, we charge a Service Fee when a booking is confirmed.

  • Except as otherwise provided on the Platform, Service Fees are non-refundable.

  • The User will be informed before any application of the Service Fees, when required.

  • The methods of calculation of the Service Fees in force that can be found below and are provided for information purposes only and do not have contractual value.

  • The Service Fee is split between the Driver and Passenger. Passengers are charged R2 plus 3.5% of the Ride price while Drivers are charged 10% of the Ride price.

  • LongDrive reserves the right to change the Service Fees at any time and will provide Users notice of any fee changes before they become effective. Fee changes will not affect bookings made prior to the effective date of the fee change. If you disagree with a fee change you may terminate this agreement at any time.


  1. Collection mandate

  • In using the Platform as Driver, you confer on LongDrive a collection mandate for the Ride price in your name and on your behalf.

  • Consequently, LongDrive shall collect the whole of the sum paid by the Passenger (Service Fees plus Ride price).

  • The Ride price received by LongDrive are deposited in an account dedicated to payment of the Drivers net of the Driver’s Service Fee.

  • You recognise and accept that none of the sums received by LongDrive in the name and on behalf of the Driver gives entitlement to interest.

  • You agree to respond diligently to any request of LongDrive, and more generally of any administrative or court authority competent particularly in the prevention or combating of money laundering. Notably, you agree to provide, on simple request, any useful evidence of address and/or identity.

  • In the absence of response to these requests, LongDrive may take any measure it deems appropriate, notably freezing of the sums paid and/or suspension of your Account and/or termination of these T&Cs.


  1. Payment of the Ride price to the Driver

  • After the Trip, the Passengers shall have a period of 12 hours to submit a Claim on the Trip to LongDrive. In the absence of Claim of the Passengers within this period, LongDrive shall consider the Trip confirmed.

  • To submit a Claim after a Trip as a Passanger, simply go to the “Help” button and send a WhatsApp message detailing your Claim.

  • From the time of this express or tacit confirmation, you shall have, as a Driver, a credit payable on your Account. This credit corresponds to the total amount paid by the Passenger at the time of confirmation of the booking reduced by the Driver’s Service Fees.

  • When the Trip is confirmed, the money will be deposited into your wallet as a Driver, and you will be able to withdraw such money into your bank account.

  • The withdrawal request from the wallet will be actioned in the first working day after your request.


  1. Wallet Functionality and Payments Methods

  • LongDrive make use of the Wallet method which is integrated to the third-party secured payment system.

  • Users of the Platform should only transact via online banking only within the Platform. This will be facilitated by LongDrive via the Wallet functionality. Payment for any booking made through the Platform is made via online banking only.

  • To deposit money into the wallet, Users will be required to input their card name, card number, expiry date and CVV number.

  • No booking confirmation shall be issued before the full and effective payment of the Trip costs. If the payment is irregular, incomplete, or not made for any reason, the booking shall be cancelled immediately.

  • The booking is confirmed via push notification to the mobile phone being used to operate the Platform.

  • Confirmation of the booking is final. Consequently, any changes will result in cancellation and as such cancellation policy shall apply.


  1. Cancellation policy

  • LongDrive does not offer any guarantee, of any nature, in the case of a cancellation for any reason. The cancellation of a seat by the Driver or the Passenger after booking confirmation is subject to the stipulations hereunder:

    1. Cancellation by Driver

  • The Passenger is refunded the whole of the sum paid amount (i.e., The Ride price and the related Service Fees).

  • The Driver will be charged 15% of the Ride price should they cancel the Trip within 24 hours from the time they accepted their first offered seat; and

  • 50% of the Ride price after 24 hours from the time they accepted their first offered Trip.

  • These charges to the Driver will be rolled onto their future Trip transactions should the Driver has insufficient funds in their wallet at the time of cancellation.


  1. Cancellation by Passenger

  • If the Passenger cancels within 24 hours from the time their booking is accepted, they will be refunded 85% of the total money paid for booking such Trip as LongDrive will retain the 15% to pay the online banking fees applicable when the transaction was confirmed - the Driver does not receive any sum of any nature.

  • If the Passenger cancels after 24 hours from the time their booking is accepted, they will be refunded 50% of the total money paid for booking such Trip as LongDrive will retain the 15% to pay the online banking fees applicable when the transaction was confirmed - the Driver will receive 35% less the Service Fee applicable.


  1. Right of withdrawal

  • You have no right of withdrawal once the booking is accepted.


  1. Behaviour of Users of the Platform

  • You recognise being solely responsible for respecting all laws, regulations, and obligations applicable to your use of the Platform.

  • Furthermore, when using the Platform and during Trips, you undertake:

  1. not to use the Platform for professional, commercial or profit-making purposes;

  2. not to send LongDrive or the other Users any false, misleading, malicious or fraudulent information;

  3. not to speak or behave in any way or post any content on the Platform of a defamatory, injurious, obscene, pornographic, vulgar, offensive, aggressive, uncalled-for, violent, threatening, harassing, racist or xenophobic nature, or with sexual connotations, inciting violence, discrimination or hatred, encouraging activities or the use of illegal substances, or more generally contrary to the purposes of the Platform, that may infringe the rights of LongDrive or a third party or contrary to good morals;

  4. not to infringe the rights and image of LongDrive, notably its intellectual property rights;

  5. not to open more than one Account on the Platform and not to open an Account in the name of a third party;

  6. not to try to bypass the online booking system of the Platform, notably by trying to send another User your contact details in order to make the booking outside of the Platform and avoid paying the Service Fees;

  7. not to contact another User, notably via the Platform, for a purpose other than defining the terms of the ridesharing;

  8. not to accept or make payment outside of the Platform;

  9. to comply with these T&Cs and the Privacy Policy.








  1. Undertakings of the Drivers

  • When you use the Platform as Driver, you undertake:

  1. to respect all laws, regulations and codes applicable to driving and the vehicle, notably to hold civil liability insurance valid at the time of the Trip and to be in possession of a valid driving licence;

  2. to check that your insurance covers ridesharing and that your Passengers are considered as third parties in your vehicle and are therefore covered by your insurance;

  3. not to take any risk when driving, not to take any product that may impair your attention and your abilities to drive vigilantly and completely safely;

  4. to post Trips corresponding only to Trips actually planned;

  5. to make the Trip as described in the post (notably with regard to using or not using the motorway) and to respect the times and places agreed with the other Users (notably meeting place and drop-off point);

  6. not to take more Passengers than the number of seats indicated in Trip post;

  7. to use a vehicle in good working order and which complies with the applicable legal provisions and customs;

  8. to communicate to LongDrive or any Passenger who so requests your driving licence, your car registration certificate, your insurance certificate, and any document demonstrating your capacity to use the vehicle as Driver on the Platform;

  9. in the case of holdup or change to the time or the Trip, to inform your Passengers without delay;

  10. to wait for Passengers at the agreed meeting place for at least 30 minutes after the agreed time;

  11. not to post a ride relative to a vehicle you do not own or that you are not authorised to use for the purposes of ridesharing;

  12. to ensure you can be contacted by your Passengers by phone on the number registered on your profile;

  13. not to generate any profit via the Platform;

  14. not to have any contraindication or medical incapacity for driving;

  15. to behave appropriately and responsibly during the Trip, and in compliance with the spirit of ridesharing.


  1. Undertakings of the Passengers

  • When you use the Platform as Passenger of a Trip, you undertake:

  1. to adopt appropriate behaviour during the Trip so as not to hinder the concentration or driving of the Driver or the peace and quiet of the other Passengers;

  2. to respect the Driver’s vehicle and its cleanliness;

  3. in the case of holdup, to inform the Driver without delay;

  4. to wait for the Driver at the meeting place for at least 30 minutes beyond the agreed time;

  5. to communicate to LongDrive, or any Driver who so asks, your identity card or any document evidencing your identity;

  6. not to carry during a Trip any item, goods, substance or animal that could hinder the driving and concentration of the Driver, or the nature, possession or carriage of which is contrary to the legal provisions in force;

  7. to ensure you can be contacted by your Passengers by phone on the number registered on your profile, including at the meeting point.

  8. In the event where you have made a booking for one or more seats on behalf of third parties, you guarantee respect by this third party for the stipulations of this article, and generally these T&Cs.

  • LongDrive reserves the right to suspend your Account, limit your access to the services, or terminate these T&Cs, in the case of breach by the third party on whose behalf you have booked a seat under these T&Cs.


  1. Suspension of accounts, limitation of access and termination

  • You can terminate your contractual relations with LongDrive at any time, without cost and without reason. To do this, simply go to the “Help” button and send a WhatsApp message requesting your account to be closed.

  • In the event of breach by you of these T&Cs, including but not limited to your obligations mentioned above if LongDrive has genuine reason to believe that this is necessary to protect its security and its integrity, that of the Users or third parties, or for the purpose of prevention of fraud or investigations, LongDrive reserves the right to:

  1. terminate the T&Cs binding you with LongDrive immediately and without notice; and/or

  2. prevent the posting of or removing any review, post, message, content, booking request, or any content posted by you on the Platform; and/or

  3. limit your access and your use of the Platform; and/or

  4. temporarily or permanently suspend your Account.

  • When this is necessary, you will be notified of the establishment of such measures to enable you to give explanations to LongDrive. LongDrive will decide, at its sole discretion, whether to lift the measures put in place.


  1. Personal data

  • In the context of your use of the Platform, LongDrive will collect and process some of your personal data.

  • In using the Platform and registering as User, you recognise and accept the processing of your personal data by LongDrive in compliance with the applicable law and the stipulations of the Privacy Policy.

  • Your personal data includes Full Names, Identity Number, Cell Phone Number, Banking Details and Email Adress.

  • Your personal data will be store by LongDrive within the Cloud and or Servers that LongDrive make use of.

  • You accept and acknowledge that LongDrive will store your personal data in their Server and or Cloud database for as long as you are a User of the Platform.


  1. Intellectual property

  • Subject to the contents provided by its Users LongDrive is the sole holder of all intellectual property rights relating to the Platform, its content (notably texts, images, designs, logos, videos, sounds, data, graphics) and to the software and databases ensuring their operation.

  • LongDrive grants you a non-exclusive, personal, and non-transferable right to use the Platform and the Services, for your personal and private use, on a non-commercial basis and in compliance with the purposes of the Platform.

  • You are prohibited from any other use or exploitation of the Platform, and their content, without the prior written permission of LongDrive. Notably, you are prohibited from:

  1. reproducing, modifying, adapting, distributing, publicly representing and disseminating the Platform, and the content, with the exception of that expressly authorised by LongDrive;

  2. decompiling and reverse engineering the Platfort, subject to the exceptions stipulated by the texts in force;

  3. extracting or attempting to extract (notably using data mining robots or any other similar data collection tool) a substantial part of the data of the Platform.


  1. Role of LongDrive

  • The Platform constitutes an online mobility Platform on which the Users can create and post Trips for the purposes of ridesharing.

  • In using the Platform and in accepting these T&Cs, you recognise that LongDrive is not party to any agreement entered into between you and the other Members with a view to sharing the costs relating to a Trip.

  • LongDrive has no control over the behaviour of its Members and the Users of the Platform. It does not own, exploit, supply or manage the vehicles subject of the posts, and it does not offer any Trips on the Platform.

  • You recognise and accept that LongDrive does not control the validity, truthfulness or legality of the posts, seats and Trips offered. In its capacity of ridesharing intermediary, LongDrive does not provide any transport service and does not act in the capacity of carrier; the role of LongDrive is limited to facilitating access to the Platform.

  • Users act under their sole and full responsibility.

  • In its capacity of intermediary, LongDrive cannot be held liable for the effective occurrence of a Trip and notably owing to:

  1. erroneous information communicated by the Driver in his post, or by any other means with regard to the Trip and its terms,

  2. cancellation or modification of a Trip by a User;

  3. the behaviour of its Members during, before or after the Trip.


  1. Operation, availability and functionalities of the Platform

  • LongDrive shall try as far as possible to maintain the Platform accessible 7 days a week and 24 hours a day. Nevertheless, access to the Platform may be temporarily suspended, without notice, owing to technical maintenance, migration or update operations, or owing to outages or constraints linked to the operation of the network.

  • Furthermore, LongDrive reserves the right to modify or suspend all or part of access to the Platform or its functionalities, at its sole discretion, temporarily or permanently.


  1. Modification of the T&Cs

  • These T&Cs and the documents integrated by reference express the entire agreement between you and LongDrive relative to your use of the Platform. Any other document, notably any mention on the Platform (FAQ, etc.), is for guideline purposes only.

  • LongDrive may modify these T&Cs in order to adapt to its technological and commercial environment, and to comply with the legislation in force. Any modification to these T&Cs will be published on the Platform with mention of the date of effect, and you will be notified by LongDrive before it takes effect.




  1. Financial conditions

  • Access to and registration on the Platform, as well as searching and viewing are free of charge. However, the booking is charged under the conditions described above.


  1. Disclaimer of Warranties

  • We provide the LongDrive Platform and all Content “as is” without warranty of any kind and we disclaim all warranties, whether express or implied. For example: (i) we do not endorse or warrant the existence, conduct, performance, safety, quality, legality or suitability of any Driver, Passenger, Finding or Posting ride services, Searching, or third party; (ii) we do not warrant the performance or non-interruption of the Platform; and (iii) we do not warrant that verification conducted on Users will identify past misconduct or prevent future misconduct.

  • Any references to verified User (or similar language) indicate only that the User or LongDrive has completed a relevant verification or identification process and nothing else.

  • The disclaimers in these T&Cs apply to the maximum extent permitted by law. If you have statutory rights or warranties we cannot disclaim, the duration of any such statutorily required rights or warranties, will be limited to the maximum extent permitted by law.


  1. Limitations on Liability

  • Neither LongDrive (including its affiliates and personnel) nor any other party involved in creating, producing, or delivering the Platform or any Content will be liable for any incidental, special, exemplary or consequential damages, including lost money, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these T&Cs, (ii) the use of or inability to use the Platform or any Content, (iii) any communications, interactions or meetings you may have with someone you interact or meet with through, or as a result of, your use of the Platform, or (iv) posting or booking of a ride, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not LongDrive has been informed of the possibility of such damage, even if a limited remedy set out in these T&Cs is found to have failed of its essential purpose.

  • Except for our obligation to transmit payments to Drivers under these T&Cs, in no event will LongDrive’s aggregate liability for any claim or dispute arising out of or in connection with these T&Cs, your interaction with any Users, or your use of or inability to use the Platform or any content, exceed: (A) to Passengers, the amount you paid as a Passenger during the 12-month period prior to the event giving rise to the liability, (B) to Driver, the amount paid to you as a Driver in the 12-month period prior to the event giving rise to the liability, or (C) to anyone else, R1 000.00.

  • These limitations of liability and damages are fundamental elements of the agreement between you and LongDrive. If applicable law does not allow the limitations of liability set out in these T&Cs, the above limitations may not apply to you.






  1. Indemnification

  • To the maximum extent permitted by applicable law, you agree to release, defend (at LongDrive’s option), indemnify, and hold LongDrive (including LongDrive Payments, other affiliates, and their personnel) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with: (i) your breach of these T&Cs (including any supplemental or additional terms that apply to a product or feature) or our additional Legal Terms,  Policies or Standards, (ii) your improper use of the LongDrive Platform, (iii) your interaction with any User, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction or use or (iv) your breach of any laws, regulations or third party rights such as intellectual property or privacy rights.


  1. Google terms

  • In accordance with some of Google’s compulsory policies, we herewith inform you that we might be tracking your cookies as our Platform undertakes Google AdWords remarketing of any other Google AdWords feature that tracks such cookies.

  • By visiting this Platform, you agree that certain of our Google AdWords remarketing and/or other advertisements can follow you as you visit other websites that form part of Google’s Display Network (GDN).

  • Note that we shall under no circumstances be utilising any personally identifiable information as obtained through our Google AdWords remarketing campaign in any other related marketing endeavours – online or otherwise. (Such restricted utilisation of information includes the sharing of such with third parties.)

  • LongDrive shall under no circumstances be using any sensitive information of any nature on any of our remarketing tags.

  • LongDrive shall duly endeavour to adhere to all of the current in-effect policies of Google related to remarketing or any other form of Google advertising in all of its Google AdWords marketing campaigns. (In instances of possible non-conformity to such, we shall endeavour to rectify such in a prompt manner.)

  • You may opt out of seeing advertisements for the Platform, by simply clicking here: –

  • We have implemented certain Google Analytics features for the primary purpose of attempting to ascertain the success of our online marketing endeavours via the Google AdWords platform.
